These Terms of Use govern your access to and use of the website flushdraineu.world and the routine planning platform services provided by Flushdraineu (ABN 83 647 291 056). By using our services, you agree to these terms.
1. Service Description
Flushdraineu provides a digital platform for designing, managing, and following structured daily routines. The platform is an organisational and personal planning tool — it does not provide medical advice, diagnosis, or professional counselling. See our Disclaimer.
2. Eligibility
You must be at least 16 years old to use our services. By creating an account or submitting a contact form, you confirm that you meet this requirement and that the information you provide is accurate.
3. Account Responsibilities
- Maintain the confidentiality of your login credentials
- Notify us immediately of any unauthorised access
- Use the platform only for lawful purposes
- Do not share, resell, or sublicense platform access without written permission
4. Acceptable Use
You agree not to:
- Upload harmful, offensive, or illegal content
- Attempt to breach platform security or access other users' private data
- Use automated tools to scrape or overload our systems
- Misrepresent your identity or affiliation
5. Intellectual Property
All platform content, design, and software are owned by Flushdraineu or its licensors. You retain ownership of content you create (journal entries, notes). You grant us a limited licence to store and display your content as needed to provide the service.
6. Service Availability
We aim to maintain continuous availability but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible. We are not liable for downtime caused by factors beyond our reasonable control.
7. Australian Consumer Law
Our services come with consumer guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be lawfully excluded.
8. Limitation of Liability
To the fullest extent permitted by law (and subject to Section 7 above), Flushdraineu is not liable for indirect, incidental, or consequential damages arising from your use of the platform. Where liability cannot be excluded, our total liability is limited to the fees paid by you in the 12 months preceding the claim, or re-supply of the services, at our option.
9. Termination
We may suspend or terminate access for violations of these terms. You may cancel your account at any time by contacting us. Upon termination, your data will be handled according to our Privacy Policy.
10. Governing Law
These terms are governed by the laws of Victoria, Australia. Disputes shall be subject to the exclusive jurisdiction of the courts of Victoria. If a dispute arises, we encourage you to contact us first. You may also contact Consumer Affairs Victoria or the ACCC for guidance on your rights.
11. Changes
We may revise these terms at any time. Updated terms will be posted on this page. Material changes will be communicated to registered users via email.
